{"id":930,"date":"2024-10-18T17:30:49","date_gmt":"2024-10-18T08:30:49","guid":{"rendered":"http:\/\/www.uppin.co.kr\/?page_id=930"},"modified":"2024-10-18T17:33:42","modified_gmt":"2024-10-18T08:33:42","slug":"use","status":"publish","type":"page","link":"https:\/\/www.uppin.co.kr\/en\/use\/","title":{"rendered":"Terms of Use"},"content":{"rendered":"<style>\n#page #ast-hf-menu-2.main-header-menu { filter: brightness(0%); }\n<\/style><div class=\"wp-block-uagb-container uagb-block-45a60ed7 alignfull uagb-is-root-container\"><div class=\"uagb-container-inner-blocks-wrap\"><div class=\"wp-block-uagb-advanced-heading uagb-block-066000bb\"><h1 class=\"uagb-heading-text\">Terms of Use<\/h1><\/div>\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-8baf4ed5\"><p class=\"uagb-heading-text\">Article 1 (Purpose)<br><br>This Agreement is intended to define the rights, obligations, and responsibilities of the cyber mall (hereinafter referred to as the \u201cMall\u201d) operated by Uppin (the e-commerce business operator) and the users of the internet-related services (hereinafter referred to as the \u201cServices\u201d) provided by the Mall.<br><br>Article 2 (Definitions)<br><br>\u2460 \u201cMall\u201d refers to a virtual business place established by the company using computers and other information and communication equipment to enable users to trade goods or services (hereinafter referred to as \u201cGoods, etc.\u201d). It also refers to the business operator who runs the cyber mall.<br>\u2461 \u201cUser\u201d refers to both members and non-members who access the \u201cMall\u201d and receive services provided by the \u201cMall\u201d in accordance with these Terms and Conditions.<br>\u2462 \u201cMember\u201d refers to a person who has registered as a member of the \u201cMall\u201d and is continuously eligible to use the services provided by the \u201cMall.\u201d<br>\u2463 \u201cNon-member\u201d refers to a person who uses the services provided by the \u201cMall\u201d without registering as a member.<br><br>Article 3 (Specification, Explanation, and Amendment of the Terms and Conditions)<br><br>\u2460 The \u201cMall\u201d shall clearly state the contents of these Terms and Conditions, the name of the company and its representative, the address of the business office (including the address where consumer complaints can be handled), telephone number, fax number, e-mail address, business registration number, and telecommunications\u2026<br>\ud310\ub9e4\uc5c5 \uc2e0\uace0\ubc88\ud638, \uac1c\uc778\uc815\ubcf4 \uad00\ub9ac \ucc45\uc784\uc790 \ub4f1\uc744 \uc774\uc6a9\uc790\uac00 \uc27d\uac8c \uc54c \uc218 \uc788\ub3c4\ub85d \u201c\ubab0\u201d\uc758 \ucd08\uae30 \uc11c\ube44\uc2a4\ud654\uba74(\uc804\uba74)\uc5d0 \uac8c\uc2dc\ud569\ub2c8\ub2e4. \ub2e4\ub9cc, \uc57d\uad00\uc758 \ub0b4\uc6a9\uc740 \uc774\uc6a9\uc790\uac00 \uc5f0\uacb0\ud654\uba74\uc744 \ud1b5\ud558\uc5ec \ubcfc \uc218 \uc788\ub3c4\ub85d \ud560 \uc218 \uc788\uc2b5\ub2c8\ub2e4.<br>\u2461 Before a user agrees to the Terms and Conditions, the \u201cMall\u201d must provide a separate linked page or a pop-up window that clearly presents important information stipulated in the Terms\u2014such as withdrawal of offer, delivery responsibilities, and refund conditions\u2014so that the user can fully understand and confirm such details.<br>\u2462 The \u201cMall\u201d may amend these Terms and Conditions within the scope that does not violate relevant laws, including the Act on Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Basic Act on Electronic Documents and Electronic Transactions, the Electronic Financial Transactions Act, the Electronic Signatures Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Door-to-Door Sales Act, and the Framework Act on Consumers, among others.<br>\u2463 If the \u201cMall\u201d amends the Terms and Conditions, it shall specify the effective date and the reason for the amendment, and notify users on the initial page of the \u201cMall\u201d at least 7 days prior to the effective date, along with the current Terms and Conditions. However, if the amendment is disadvantageous to users, the notice shall be made at least 30 days in advance. In this case, the \u201cMall\u201d will clearly highlight the differences between the pre-amendment and post-amendment versions to make it easier for users to understand.<br>\u2464 If the \u201cMall\u201d amends the Terms and Conditions, the amended Terms shall apply only to contracts entered into after the effective date of the amendments. For contracts already entered into before the effective date, the provisions of the Terms in effect at the time the contract was concluded shall remain applicable. However, if a user who has already entered into a contract wishes to be subject to the amended Terms, they may send such a request to the \u201cMall\u201d within the notification period specified in Article 3, and if the \u201cMall\u201d agrees, the amended Terms shall apply.<br>\u2465 Matters not specified in these Terms and Conditions and the interpretation of these Terms shall be governed by the Act on Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Consumer Protection Guidelines for Electronic Commerce set by the Fair Trade Commission, relevant laws and regulations, or customary practices.<br><br>Article 4 (Provision and Change of Services)<br><br>\u2460 The \u201cMall\u201d performs the following tasks.<br>1.Providing information about goods or services and concluding purchase contracts.<br>2. Delivery of goods or services for which a purchase contract has been concluded.<br>3.Other tasks specified by the \u201cMall.\u201d<br>\u2461 In the event of out-of-stock goods or services, or changes in technical specifications, the \u201cMall\u201d may modify the content of the goods or services to be provided under future contracts. In such cases, the modified details of the goods or services and the provision date will be immediately announced at the place where the current details of the goods or services were posted.<br>\u2462 If the \u201cMall\u201d changes the content of the service contracted with the user due to reasons such as out-of-stock goods or services or changes in technical specifications, the \u201cMall\u201d shall immediately notify the user of the reason at an address where the user can receive notifications.<br>\u2463 In the case of the previous paragraph, the \u201cMall\u201d shall compensate for any damages incurred by the user. However, this does not apply if the \u201cMall\u201d proves that it was not at fault or did not act intentionally.<br><br>Article 5 (Suspension of Services)<br><br>\u2460 The \u201cMall\u201d may temporarily suspend the provision of services in the event of maintenance, replacement, or malfunction of information and communication equipment, or due to interruptions in communication.<br>\u2461 The \u201cMall\u201d shall compensate for any damages incurred by the user or a third party due to the temporary suspension of services for the reasons mentioned in Paragraph 1. However, this does not apply if the \u201cMall\u201d proves that it was not at fault or did not act intentionally.<br>...<br>\u2462 If the \u201cMall\u201d is unable to provide services due to reasons such as a change in business type, abandonment of business, or merger with another company, the \u201cMall\u201d shall notify the user in the manner specified in Article 8 and provide compensation to the consumer in accordance with the conditions originally presented by the \u201cMall.\u201d However, if the \u201cMall\u201d has not specified compensation criteria, the \u201cMall\u201d will provide users with tangible goods or cash equivalent to the value of mileage or reward points in the currency used by the \u201cMall.\u201d<br><br>Article 6 (Membership Registration)<br><br>\u2460 A user applies for membership registration by filling out the membership information in accordance with the registration form specified by the \u201cMall\u201d and indicating their intention to agree to these Terms and Conditions.<br>\u2461 The \u201cMall\u201d shall register users who have applied for membership as members, unless they fall under any of the following categories.<br>1.If the applicant has previously lost membership status under Article 7, Paragraph 3 of these Terms, they may reapply for membership only if three years have passed since the loss of membership, and they have obtained the \u201cMall\u2019s\u201d approval for rejoining.<br>2.If there is false information, missing details, or typographical errors in the registration information.<br>3. If registering the user as a member is deemed to cause significant technical difficulties for the \u201cMall.\u201d<br>\u2462 The time of establishment of the membership contract shall be when the \u201cMall\u201d\u2019s acceptance reaches the user.<br>\u2463 If there are any changes to the information registered during membership sign-up, the member must notify the \u201cMall\u201d of the changes through methods such as updating their membership information within a reasonable period of time.<br><br>Article 7 (Withdrawal of Membership and Loss of Eligibility, etc.)<br><br>\u2460 Members may request withdrawal from the \u201cMall\u201d at any time, and the \u201cMall\u201d will immediately process the withdrawal.<br>\u2461 If a member falls under any of the following reasons, \u201cMall\u201d may restrict or suspend membership.<br>1. If false information is registered when applying for membership<br>2. If the member does not pay the price of goods purchased using the \u201cMall\u201d or any other debts incurred by the member in relation to the use of the \u201cMall\u201d by the due date.<br>3. In case of threatening the order of e-commerce, such as interfering with another person\u2019s use of \u201cMall\u201d or stealing information<br>4. When using \u201cMall\u201d to commit an act prohibited by law or these Terms and Conditions or against public order and morals<br>\u2462 If the same act is repeated more than twice or the reason is not corrected within 30 days after \u201cMall\u201d has restricted or suspended membership, \u201cMall\u201d may revoke the membership.<br>\u2463 If a \u201cMall\u201d loses its membership qualifications, the membership registration will be canceled. In this case, the member will be notified and given at least 30 days to explain before the membership registration is canceled.<br><br>Article 8 (Notice to members)<br><br>\u2460 When \u201cMall\u201d notifies a member, it may do so via the e-mail address designated in advance through agreement between the member and \u201cMall.\u201d<br>\u2461 In the case of notification to an unspecified number of members, \u201cMall\u201d may substitute individual notification by posting on the \u201cMall\u201d bulletin board for at least one week. However, individual notification will be provided for matters that have a significant impact on the member\u2019s own transactions.<br><br>Article 9 (Purchase application and consent to provision of personal information, etc.)<br><br>\u2460 \u201cMall\u201d users apply for purchases on the \u201cMall\u201d using the following or similar methods, and the \u201cMall\u201d must provide the following information in an easily understandable manner when users apply for purchases.<br>1. Search and select goods, etc.<br>2. Enter the recipient's name, address, phone number, email address (or mobile phone number), etc.<br>3. Confirm the terms and conditions, services with limited right of withdrawal, and cost burden such as delivery and installation fees.<br>4. Indicate that you agree to these terms and confirm or reject the items in item 3 above (e.g., by clicking the mouse)<br>5. Application for purchase of goods, etc. and confirmation thereof or consent to confirmation by \u201cMall\u201d<br>6. Choose a payment method<br>\u2461 In cases where the \u201cMall\u201d needs to provide the purchaser\u2019s personal information to a third party, the following must be notified to the purchaser and consent must be obtained: 1) the person receiving the personal information, 2) the purpose of the personal information use by the person receiving the personal information, 3) the items of personal information provided, and 4) the period of retention and use of the personal information by the person receiving the personal information. (The same applies when the matters for which consent has been obtained are changed.)<br>\u2462 In the event that \u201cMall\u201d entrusts a third party with handling the purchaser\u2019s personal information, 1) the person entrusted with handling personal information, and 2) the content of the work for which personal information handling is being entrusted must be notified to the purchaser and consent must be obtained. (The same applies if the matters for which consent has been obtained are changed.) However, in the event that it is necessary for the performance of a contract for the provision of services and is related to the enhancement of the purchaser\u2019s convenience, the notification and consent procedures may be omitted by notifying through the personal information handling policy in the manner stipulated in the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.<br><br>Article 10 (Establishment of contract)<br><br>\u2460 \u201cMall\u201d may not accept purchase applications under Article 9 in the following cases. However, in the case of entering into a contract with a minor, the minor or the legal representative may cancel the contract if the consent of the legal representative is not obtained.<br>1. If there is any false information, omission, or error in the application<br>2. When a minor purchases goods or services prohibited by the Youth Protection Act, such as cigarettes or alcohol.<br>3. In cases where it is judged that approving other purchase requests significantly hinders the technology of \u201cMall\u201d<br>\u2461 The contract is deemed to have been concluded when the \u201cMall\u201d approval reaches the user in the form of a receipt confirmation notice under Article 12, Paragraph 1.<br>\u2462 The \u201cMall\u201d\u2019s expression of intent to accept must include information such as confirmation of the user\u2019s purchase request, availability for sale, correction or cancellation of the purchase request, etc.<br><br>Article 11 (Payment Method)<br><br>Payment for goods or services purchased at \u201cMall\u201d can be made using any of the available methods listed below. However, \u201cMall\u201d cannot collect any additional fees of any kind for the price of goods, etc., for the user\u2019s payment method.<br>1. Various account transfers such as phone banking, internet banking, and mail banking<br>2. Payment by various cards such as prepaid cards, debit cards, and credit cards<br>3. Online bank transfer<br>4. Payment by electronic money<br>5. Payment upon receipt<br>6. Payment using points provided by \u201cMall\u201d such as mileage<br>7. Payment by gift certificate that has been contracted with \u201cMall\u201d or approved by \u201cMall\u201d<br>8. Payment by other electronic payment methods, etc.<br><br>Article 12 (Confirmation of receipt, change and cancellation of purchase application)<br><br>\u2460 When a user makes a purchase request, \u201cMall\u201d sends the user a receipt confirmation notice.<br>\u2461 Users who have received a notice of receipt confirmation may request a change or cancellation of the purchase application immediately after receiving the notice of receipt confirmation if there is a discrepancy in the expression of intent, and the \u201cMall\u201d must process the request without delay prior to delivery if the user requests it. However, if payment has already been made, the provisions of Article 15 on withdrawal of subscription, etc. shall apply.<br><br>Article 13 (Supply of goods, etc.)<br><br>\u2460 Unless there is a separate agreement between the \u201cMall\u201d and the user regarding the timing of supply of goods, etc., the \u201cMall\u201d shall take necessary measures such as custom manufacturing, packaging, etc. so that the goods can be delivered within 7 days from the date of subscription by the user. However, if the \u201cMall\u201d has already received all or part of the payment for the goods, etc., it shall take measures within 3 business days from the date of receipt of all or part of the payment. In this case, the \u201cMall\u201d shall take appropriate measures so that the user can check the supply procedure and progress of the goods, etc.<br>\u2461 The \u201cMall\u201d shall specify the means of delivery, the party responsible for the delivery costs for each means, and the delivery period for each means for the goods purchased by the user. If the \u201cMall\u201d exceeds the agreed delivery period, it shall compensate the user for any resulting damages. However, this shall not apply if the \u201cMall\u201d proves that there was no intent or negligence.<br><br>Article 14 (Refund)<br><br>If \u201cMall\u201d cannot deliver or provide the goods, etc. that the user has requested to purchase due to reasons such as out of stock, it shall promptly notify the user of the reason and, if it has received payment for the goods, etc. in advance, refund the payment or take necessary measures for a refund within 3 business days from the date of receipt of payment.<br><br>Article 15 (Withdrawal of subscription, etc.)<br><br>\u2460 Users who have entered into a contract for the purchase of \u201cMall\u201d and goods, etc. may withdraw their subscription within 7 days from the date of receipt of the written contract in accordance with Article 13, Paragraph 2 of the Act on Consumer Protection in Electronic Commerce, etc. (if the supply of goods, etc. is made later than the date of receipt of the written contract, the date of receipt of the goods, etc. or the date on which the supply of goods, etc. commences). However, if the Act on Consumer Protection in Electronic Commerce, etc. provides otherwise regarding the withdrawal of subscription, the provisions of said Act shall apply.<br>\u2461 In the event that a user receives goods, etc., he\/she cannot return or exchange them in any of the following cases:<br>1. If the goods are lost or damaged due to a reason attributable to the user (however, if the packaging is damaged in order to check the contents of the goods, the subscription may be cancelled)<br>2. When the value of goods, etc. has significantly decreased due to use or partial consumption by the user.<br>3. When the value of goods, etc. has significantly decreased over time to the extent that resale is difficult.<br>4. If the packaging of the original product is damaged when it can be duplicated with a product of the same performance.<br>\u2462 In the cases of subparagraphs 2 through 4 of paragraph 2, if the \u201cmall\u201d does not take measures such as clearly stating in advance in a place where consumers can easily see that cancellation of subscription, etc. is restricted or providing trial products, the user\u2019s cancellation of subscription, etc. is not restricted.<br>\u2463 Notwithstanding the provisions of Paragraphs 1 and 2, if the content of the goods, etc. is different from the displayed or advertised content or if the performance is different from the contractual content, the user may cancel the subscription, etc. within 3 months from the date of receipt of the goods, etc. or within 30 days from the date the user learned or could have learned of the fact.<br><br>Article 16 (Effect of withdrawal of subscription, etc.)<br><br>\u2460 In the event that the \u201cMall\u201d receives a return of goods, etc. from a user, it shall refund the amount already paid for the goods, etc. within 3 business days. In this case, if the \u201cMall\u201d delays the refund of goods, etc. to the user, it shall pay the delayed interest calculated by multiplying the delayed interest rate stipulated in Article 21-3 of the \u201cEnforcement Decree of the Act on Consumer Protection in Electronic Commerce, etc.\u201d by the delay period.<br>\u2461 When refunding the above amount, if the user has paid for the goods, etc. using a payment method such as a credit card or electronic money, \u201cMall\u201d will request the business that provided the payment method to suspend or cancel the claim for the goods, etc. without delay.<br>\u2462 In the event of withdrawal of subscription, etc., the cost required to return the goods supplied shall be borne by the user. \u201cMall\u201d shall not claim a penalty or compensation for damages from the user for reasons such as withdrawal of subscription. However, in the event of withdrawal of subscription, etc. due to the content of the goods, etc. being different from the displayed or advertised content or being performed differently from the contractual content, \u201cMall\u201d shall bear the cost required to return the goods, etc.<br>\u2463 In cases where the user pays for shipping costs when receiving goods, etc., \u201cMall\u201d clearly indicates who will bear the costs when the subscription is cancelled so that the user can easily understand.<br><br>Article 17 (Personal Information Protection)<br><br>\u2460 \u201cMall\u201d collects the minimum amount of personal information necessary to provide services when collecting users\u2019 personal information.<br>\u2461 \u201cMall\u201d does not collect information necessary for the performance of a purchase contract in advance when registering as a member. However, this does not apply in cases where identity verification is required prior to a purchase contract in order to perform obligations under relevant laws and regulations, and where the minimum amount of specific personal information is collected.<br>\u2462 When \u201cMall\u201d collects and uses a user\u2019s personal information, it notifies the user of the purpose and obtains consent.<br>\u2463 \u201cMall\u201d cannot use the collected personal information for purposes other than the intended purpose, and if a new purpose of use arises or if it is provided to a third party, the purpose will be notified to the relevant user and consent will be obtained at the stage of use\/provision. However, if there are other provisions in related laws and regulations, there are exceptions.<br>\u2464 In cases where \u201cMall\u201d must obtain the consent of users pursuant to Paragraphs 2 and 3, the identity of the personal information manager (affiliation, name, phone number, and other contact information), purpose of information collection and use, matters related to provision of information to third parties (recipient, purpose of provision, and content of information to be provided), etc. as stipulated in Article 22 Paragraph 2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. must be specified or notified in advance, and users may withdraw this consent at any time.<br>\u2465 Users may request access to and correction of errors in their personal information held by the \u201cMall\u201d at any time, and the \u201cMall\u201d is obligated to take necessary measures without delay. If a user requests correction of an error, the \u201cMall\u201d will not use the relevant personal information until the error is corrected.<br>\u2466 \u201cMall\u201d shall limit the number of persons handling the personal information of users to the minimum in order to protect personal information, and shall be fully responsible for any damage suffered by users due to loss, theft, leakage, provision to a third party without consent, alteration, etc. of the personal information of users, including credit cards and bank accounts.<br>\u2467 \u201cMol\u201d or a third party that has received personal information from it shall destroy the personal information without delay when the purpose of collecting or providing the personal information has been achieved.<br>\u2468 \u201cMall\u201d does not pre-select the consent box for the collection, use, and provision of personal information. In addition, it specifically states the services that are restricted when the user refuses to consent to the collection, use, and provision of personal information, and does not restrict or refuse the provision of services such as membership registration due to the user\u2019s refusal to consent to the collection, use, and provision of personal information that is not a mandatory collection item.<br><br>Article 18 (Duties of \u201cMall\u201d)<br><br>\u2460 \u201cMall\u201d shall not engage in any acts prohibited by laws and regulations or these Terms and Conditions or against public order and morals, and shall do its best to provide goods and services continuously and stably in accordance with these Terms and Conditions.<br>\u2461 \u201cMall\u201d must have a security system to protect users\u2019 personal information (including credit information) so that users can safely use Internet services.<br>\u2462 If a \u201cMall\u201d causes damage to a user by engaging in unfair labeling or advertising practices as defined in Article 3 of the Act on Fair Labeling and Advertising with respect to a product or service, the \u201cMall\u201d shall be liable for compensation for such damage.<br>\u2463 \u201cMall\u201d does not send commercial e-mails for profit that users do not want.<br><br>Article 19 (Member\u2019s obligations regarding ID and password)<br><br>\u2460 Except for the case in Article 17, the member is responsible for managing his\/her ID and password.<br>\u2461 Members must not allow third parties to use their ID and password.<br>\u2462 If a member becomes aware that his\/her ID and password have been stolen or are being used by a third party, he\/she must immediately notify the \u201cMall\u201d and follow any instructions provided by the \u201cMall\u201d.<br><br>Article 20 (User Obligations)<br><br>Users must not perform the following actions:<br>1. Registration of false information when applying or changing information<br>2. Stealing other people's information<br>3. Changes to information posted on \u201cMall\u201d<br>4. Transmission or posting of information (computer programs, etc.) other than information specified by \u201cMall\u201d<br>5. Infringement on intellectual property rights, including copyrights, of \u201cMall\u201d or other third parties<br>6. Acts that damage the reputation of \u201cMol\u201d or other third parties or interfere with their business<br>7. Acts of disclosing or posting obscene or violent messages, images, voices, or other information that is against public order and morals on the mall<br><br>Article 21 (Attribution of copyright and restrictions on use)<br><br>\u2460 The copyright and other intellectual property rights for works created by \u201cMall\u201d belong to \u201cMall.\u201d<br>\u2461 Users may not use for profit or allow third parties to use for profit information obtained through the use of the \u201cMall\u201d, including information to which the \u201cMall\u201d holds intellectual property rights, by means of copying, transmitting, publishing, distributing, broadcasting or any other method without the prior consent of the \u201cMall.\u201d<br>\u2462 \u201cMall\u201d must notify the user in case it uses the copyright belonging to the user according to the agreement.<br><br>Article 22 (Dispute Resolution)<br><br>\u2460 \u201cMall\u201d establishes and operates a damage compensation processing organization to reflect legitimate opinions or complaints raised by users and compensate for the damages.<br>\u2461 \u201cMall\u201d gives priority to complaints and opinions submitted by users. However, if prompt processing is difficult, the user will be notified immediately of the reason and processing schedule.<br>\u2462 In the event that a user files a request for relief for damages in connection with an e-commerce dispute that has arisen between \u201cMall\u201d and the user, the request may be subject to the mediation of a dispute resolution agency commissioned by the Fair Trade Commission or the city\/provincial governor.<br><br>Article 23 (Jurisdiction and Governing Law)<br><br>\u2460 Litigation regarding disputes over e-commerce that arise between \u201cMall\u201d and users shall be under the exclusive jurisdiction of the local court with jurisdiction over the user\u2019s address at the time of filing the lawsuit, or if there is no address, the user\u2019s place of residence. However, if the user\u2019s address or place of residence is unclear at the time of filing the lawsuit, or if the user is a foreign resident, the lawsuit shall be filed with the court with jurisdiction under the Civil Procedure Act.<br>\u2461 Korean law applies to e-commerce lawsuits filed between \u201cMall\u201d and users.<br><br>Supplementary provisions<br><br>These terms and
